These Terms of Service ("Terms") govern your use of the NiceTry service and website. By accessing or using NiceTry, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

1. Service Description

NiceTry is an AI-powered content detection service that helps users identify artificially generated images, videos, and media across social platforms including Instagram, TikTok, X/Twitter, YouTube, and others. Our Service provides:

• Real-time scanning of images for AI generation detection
• Confidence scores and detailed verdict reports
• Browser extensions for integrated platform scanning
• Account management and scan history storage
• Premium features depending on subscription tier

NiceTry provides detection assistance but does not guarantee 100% accuracy. Users should always exercise independent judgment when evaluating content.

2. Account Responsibility

Account Creation

To use NiceTry, you must create an account. You are responsible for:

• Providing accurate, current, and complete information
• Maintaining the confidentiality of your password
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

Age Requirements

You must be at least 13 years old to use NiceTry (or the age of digital consent in your jurisdiction). If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

Account Termination

We reserve the right to suspend or terminate any account that violates these Terms or poses a risk to the Service or other users.

3. Acceptable Use Policy

You agree not to use NiceTry to:

• Violate any local, state, national, or international law
• Harass, threaten, intimidate, or harm any person
• Distribute malware, viruses, or malicious code
• Attempt to gain unauthorized access to our systems
• Submit non-consensual intimate images or "deepfake" pornography
• Defame or spread disinformation about individuals or organizations
• Engage in any form of fraud, deception, or impersonation
• Spam, phish, or perform social engineering attacks
• Circumvent security measures or reverse-engineer the Service
• Abuse or interfere with the normal operation of NiceTry

Violations of this policy may result in immediate account suspension and legal action.

4. Subscription and Payment

Subscription Plans

NiceTry offers the following subscription tiers:

• Standard Plan: $5-15/month (Individual)
• Premium Plan: $10-25/month (Individual)
• Family Plan: Available for both Standard and Premium tiers
• YouTube Member Credit: $5/month discount for YouTube channel members

Billing and Renewal

Subscriptions are billed monthly on the anniversary of your sign-up date. Your subscription will automatically renew unless you cancel before the renewal date. We will send you a reminder email 7 days before renewal.

Payment Processing

Payments are processed through Stripe. By providing payment information, you authorize us to charge your chosen payment method. All transactions are secure and encrypted. We do not store your full credit card information.

Price Changes

We may update subscription prices with 30 days' notice. Price changes will take effect at your next renewal date. If you do not agree with the new price, you may cancel your subscription.

Refunds

Refund Policy: We offer refunds in the following cases:

• 30-day guarantee: New subscribers may request a full refund within 30 days of their first charge if the Service does not meet their expectations.
• Accidental charges: Duplicate or erroneous charges will be refunded within 5 business days.
• Service unavailability: If the Service is unavailable for more than 48 consecutive hours due to our fault, you may request a pro-rata refund.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect immediately, and you will retain access until the end of your current billing period.

5. Intellectual Property Rights

NiceTry IP

All content, software, designs, logos, and trademarks associated with NiceTry are owned by or licensed to NiceTry and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Reproduce or copy our Service for personal or commercial use
• Modify, translate, or create derivative works
• Sell or license the Service or its components
• Use our IP for any purpose other than as intended by the Service

User-Submitted Content

When you submit images or content for scanning, you represent that you own or have permission to scan that content. You grant NiceTry a non-exclusive, worldwide license to:

• Process and analyze the content for detection purposes
• Use the content (anonymized) to improve our detection models with your consent
• Store the content for your account records and service delivery

You retain all ownership rights to content you submit.

6. Limitation of Liability

No Warranties

We make no representations or warranties regarding:

• Accuracy, completeness, or reliability of detection results
• Uninterrupted or error-free Service access
• Freedom from viruses or malicious code
• Fitness for a particular purpose

Limitation of Damages

To the fullest extent permitted by law, NiceTry shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your reliance on detection results
• Third-party claims or user disputes

Our total liability shall not exceed the amount you paid for your subscription in the past 12 months (or $100, whichever is greater).

7. Indemnification

You agree to indemnify, defend, and hold harmless NiceTry and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any law or third-party rights
• Your use of the Service in a manner not intended
• Content you submit or authorize for scanning
• Your conduct on the platform

8. Termination and Suspension

Termination for Cause

We may immediately suspend or terminate your account if you:

• Violate any term in this Agreement
• Engage in illegal activity
• Pose a threat to the Service or other users
• Abuse our customer support resources

Termination for Convenience

You may terminate your account at any time by contacting support or through your account settings. NiceTry may also terminate service with 30 days' written notice for any reason.

Upon Termination

Upon termination:

• Your account access will be disabled
• You will no longer be billed
• Your data will be retained per our Privacy Policy
• Your rights to use the Service will immediately cease

9. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before the change takes effect. Your continued use of NiceTry after the changes become effective constitutes your acceptance of the updated Terms.

10. Dispute Resolution

Informal Resolution

Before pursuing any legal action, please contact us at support@trynicetry.com to attempt to resolve the dispute informally.

Binding Arbitration

Any dispute arising from these Terms or your use of NiceTry shall be resolved through binding arbitration under the American Arbitration Association (AAA) rules. You agree to submit disputes to arbitration rather than court proceedings, except for claims of IP infringement or emergency injunctive relief.

Class Action Waiver

You agree not to bring class action or representative action lawsuits against NiceTry.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. All proceedings shall take place in the state or federal courts located in San Francisco County, California.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
